6. PRODUCT SPECIFICATIONS

6.1 Features and specifications of Products described or depicted on the Bedtime Website are subject to change without notice.

6.2 Unless otherwise stated, any accessories, including but not limited to mattresses, trundles, bed guards, hutches when shown on dressers or vice versa, bedding or other furnishings shown in any Product image on the Website are not included in the price.

6.3 All weights and dimensions mentioned are approximate.

6.4 Slight colour variations may appear in products due to the settings and type of computer/mobile device from which you are viewing the website.

6.5 Reclaimed pine products are constructed from authentic recycled timber. As such no two pieces are the same. The position and prevalence of knots and nail holes along with grain and tone of the timber will vary from piece to piece and differ from samples displayed on showroom floors or photography on Bedtime’s Website. These variations are not considered flaws or faults, and no claims will be recognised for these variations.

6.6 Our Oak furniture is hand-crafted from sustainable American forests. As no two trees are alike, variation in grain and colour will occur. These imperfections along with medullary rays are considered normal and to be expected for hand finished, solid timber furniture. No claims will be recognised for these variations. Customers expecting perfectly consistent colour and grain should avoid Oak and consider synthetic materials such as laminate, wood grain melamine or PVC.

6.7 As is standard throughout the furniture industry, the rear and underside of Bedtime head and footboards and case goods are not finished to the same standard as the rest of the product and as such claims will not be recognised.

6.8 At its sole discretion, Bedtime may from time to time change factories, designs, suppliers or specifications. Bedtime takes no responsibility in guaranteeing colour or design compatibility to product previously purchased.

7. ORDERS

7.2 Offers for Products made by the Bedtime Website do not constitute an offer to sell but an invitation to treat. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions.

7.3 Orders will be deemed to have been received by Bedtime at the time Bedtime sends an Order confirmation to your nominated e-mail address.

7.4 Bedtime is an online business and will primarily communicate with customers via e-mail. It is the customer’s responsibility to ensure the correct contact details are entered and that the nominated e-mail address is regularly checked for correspondence.

7.5 Each Order (once confirmed) represents a separate agreement.

7.6 Bedtime reserves the right to not accept or to cancel Orders that request commercial quantities of Goods.

7.7 Bedtime, at its sole discretion, may cancel your Order at any time prior to dispatch of the Goods, including Products that are sold on Pre-sale.

7.9 Bedtime reserves the right to at any time alter the specification in respect of the Goods without giving notice to the Customer, in the interest of continual improvement. An alternation does not entitle the Customer to return Products, cancel an Order or otherwise avoid its obligations and liabilities pursuant to these Terms and Conditions.

7.10 Bedtime accepts no responsibility for Orders that are declined or not accepted due to disruptions with internet connections.

7.11 Bedtime reserves the right to charge an administration fee of up to 20% of the order value when orders are canceled and then reinstated by the purchaser to capture promotional discounts.

9. DELIVERY, COLLECTIONS & OWNERSHIP OF GOODS

9.1 Bedtime tries to ensure that all goods are delivered in a prompt and timely manner. However, from time to time it is possible that shipping and other factors outside our control may result in delays. Bedtime does not accept any liability for loss or damage suffered by anyone as a result of any such delays.

9.2 For metro and outer Melbourne Orders, the Customer will be contacted by Bedtime customer support and a delivery date and time window arranged. For all other delivery addresses, the Customer will be notified once the Goods have left Bedtime’s warehouse and thereafter the Customer will be contacted by a third party delivery company with dates and times of delivery.

9.3 Bedtime will not dispatch Goods to addresses outside Australia or PO box addresses.

9.4 Title and risk in the Goods pass to the customer on signing for the delivery of the Goods.

9.5 Where a Customer gives written authority for an item to be delivered without a signature, any and all included insurance cover will be void.

9.6 Bedtime’s nominated courier will deliver Goods during business hours (8am to 6pm, Monday to Friday) unless otherwise arranged. Our delivery service does not include the removal of packaging nor the assembly of Goods.

9.7 Bedtime is not responsible for the delivery times of Goods. Once Goods have been dispatched, it is the customer's responsibility to liaise with Bedtime’s nominated courier company in relation to the date of delivery and to make themselves available to take delivery during business hours. Any information provided by Bedtime to a customer in relation to delivery will be from a third party, and as such Bedtime will not guarantee the accuracy of such information.

9.8 Bedtime may require the customer to render physical assistance to the delivery driver in order to assist in carrying larger items from the vehicle to the delivery point in light of OH&S requirements or to delivery addresses that are outside of our standard delivery zones such as rural areas. Bedtime reserves the right to charge extra fees for customers who require a 2-man delivery.

9.9 Bedtime will dispatch in stock items within 3 business days of payment being received unless otherwise specified. Please note that if you have ordered multiple items with different expected dispatch dates, the order will be held until the final item becomes available for delivery. In the event that you are wanting multiple deliveries or deliveries to multiple addresses, further delivery charges will apply.

9.10 Bedtime will hold goods ready for dispatch or collection in warehouse storage for a maximum of one month after all items in the order are ready for dispatch or collection. Any goods remaining in the warehouse beyond the one-month period will incur a $100 per month storage fee. Goods still not collected after 6 months will be put back into stock and a fee to the value of 25% of the total order will be deducted. If the customer is uncontactable, refunds will not be issued for items reallocated into stock.

9.11 Warehouse collections may be arranged free of charge by prior arrangement from the following address: 12 Longford Court, Springvale, Victoria. Personal collections of furniture are limited to the following times and days; Monday to Friday 9am to 12 noon. Collections cannot be made from any other location or on any other day or time. The Bedtime warehouse is closed on all public holidays.

9.12 Notification of intended collection must be made 2 working days in advance to ensure goods are picked and checked.

9.13 Bedtime is able to supply carton dimensions, but cannot recommend whether a particular vehicle is appropriate to accommodate the Goods. Bedtime reserves the right to refuse collection where at our sole discretion we believe the vehicle to be unable to safely accommodate the Goods. Bedtime accepts no responsibility or liability for damage incurred by Goods during transit or caused to a vehicle when a Bedtime employee has been asked to assist in loading goods. Car seats must be removed for furniture collection.

9.14 Bedtime cannot supply blankets, tie downs, or other supplies used to load and protect Goods.

9.15 Bedtime cannot guarantee that an abled bodied person is available to assist in loading heavy Goods.

9.16 Bedtime will not accept claims for damages to Goods incurred where a customer has elected to transport them in their own vehicle. Where a customer elects to collect Goods and they are found to be faulty, it is the customers responsibility to return Goods to the place of collection for assessment.

9.17 Free delivery promotions are valid on new purchases of $1000 or more and restricted to nominated delivery zones only.

9.18 In the event of a change of mind order cancellation where an order has been received and the free shipping option has been used, customers must pay freight charges to and from to return an item(s).

9.19 Bedtime reserves the right to cancel free delivery orders based on location, or request freight contribution if delivery location is deemed to be outside nominated delivery zones.

9.20 Bedtime reserves the right to modify or discontinue the free delivery promotion at any time. Past purchases are not eligible and adjustments will not be made to previous purchases. Free delivery is non-transferable and cannot be used in conjunction with any other offer.

10. FAULTY OR DAMAGED GOODS
